31-2 RULES OF INTERPRETATION. The provisions of this Ordinance shall be held to be the minimum requirements for the promotion of the purposes of this Ordinance, and the provisions shall be interpreted in accordance with the following:

(A) Minimum Requirements. In their interpretation and application, the provisions of this Ordinance shall be held to be the minimum requirements for the promotion of the public health, safety, morals, convenience, comfort, prosperity and general welfare.

(B) Relationship to Private Agreements. This Ordinance is not intended to abrogate, annul or otherwise interfere with any easement, covenant or any other private agreement or legal relationship; provided, however, that where the regulations of the Ordinance are more restrictive or impose higher standards or requirements than such easement, covenant or other private agreement of legal relationship, the regulations of this Ordinance shall govern.

(C) Unlawful Uses. No building, structure, or use which was not lawfully existing at the time of the adoption of this Ordinance shall become or be made lawful solely by reason of the adoption of this Ordinance; and to the extent that, and in any respect that, said unlawful building, structure or use is in conflict with the requirement of this Ordinance, said building, structure, or use remains unlawful hereunder.

(D) Not a Licensing Ordinance. Nothing contained in this Ordinance shall be deemed to be a consent, license or permit to use any property or to locate, construct or maintain any building, structure or facility or to carry on any trade, industry, occupation or activity.

(E) Cumulative Provisions. The provisions of this Ordinance are cumulative and additional limitation upon all other laws and ordinances, heretofore passed or which may be passed hereafter, governing any subject matter in this Ordinance.

ORD. NO. 5631, Definitions

Duplex: See Dwelling, Two-Family.

Dwelling: A building designed exclusively to contain one (1) dwelling unit, the main body of which shall not be less than twenty (20) feet in width. The definition shall include townhouses, each as a separate dwelling unit and classified as single-family attached dwellings.

Dwelling, Single Family: A building designed exclusively to contain one (1) dwelling unit, the main body of which will not be less than twenty (20) feet in width. The definition shall include townhouses, each as a separate dwelling unit and classified as single-family attached dwellings.

Dwelling, Two Family: A building designed exclusively to contain two (2) dwelling units.

Dwelling, Multiple Family: A building designed exclusively to contain three (3) or more dwelling units, but not including townhouses.

Dwelling Unit: A building or portion of a building which is exclusively arranged, occupied, or intended to be occupied as living quarters for one family; a separate, independent living quarter consisting of one or more connected rooms with permanently installed bathroom and kitchen facilities.

Family: A family is defined as follows:
(a) Any number of people occupying a single dwelling unit living together as a single housekeeping unit, related by blood, marriage or formal adoption plus not more than (2) additional people not so related; or
(b) Not more than three (3) unrelated people living together in one single dwelling unit; or
(c) Not more than six (6) foster children plus two (2) additional persons acting as foster parents and any number of other persons related by blood, marriage or formal adoption to one or both of the foster parents. The foster home must be licensed by the Missouri Division of Family Services or the Missouri Department of Mental Health.

The number of family members cannot exceed the floor area occupancy limits contained in Article VIII, Chapter 6, of the Grandview Code of Laws. Fence: A structure bounding an area of land and designed either to limit access to the area or to screen such area from view or both, including hedges or walls. For the purposes of screening outdoor storage areas, a fence shall be defined as being constructed of wood, metal, masonry, or similar materials. The screen fence shall provide 100% opacity over the entire screen surface at a minimum height of six (6) feet above the grade of the land on which the fence is erected.

Definitions

(38) Duplex means a building designed or used exclusively for residential purposes and containing two dwelling units separated by a common party wall or otherwise structurally attached.

(39) Dwelling means a building or portion thereof designed exclusively for residential occupancy, but not including hotels or motels.

(40) Dwelling, multiple means a building or portion thereof designed for three or more dwelling units.

(41) Dwelling unit means a building or portion thereof designed exclusively for residential occupancy by one family and provided with sanitation and cooking facilities.

(42) Family means an individual; or two or more persons related by blood, marriage or adoption; or a group of not more than five persons, excluding servants, who need not be related by blood or marriage, living together and subsisting in common as a separate nonprofit housekeeping unit; or a group of eight or fewer unrelated mentally or physically handicapped persons, which may include two additional persons acting as houseparents or guardians who need not be related to each other or to any of the mentally or physically handicapped persons residing in the home.

(43) Floor area means the sum of the areas of the several floors of a building or structure, including areas used for human occupancy or required for the conduct of the business or use, and basements, attics and penthouses, as measured from the exterior faces of the wall. It does not include an area for the parking of motor vehicles.

(44) Floor area ratio (FAR) means the ratio of the floor area to the lot area, as determined by dividing the floor area by the lot area.

(45) Footprint area means the floor area at grade or the first floor if elevated above grade of an accessory building or structure and includes any enclosed area therein for the parking of motor vehicles, areas of the building not provided with surrounding walls shall be included in the building area if such areas are included within the horizontal projection of the roof or floor above.

(46) Garage, community means a building or portion thereof, other than a public or private garage, providing storage for motor vehicles with facilities for washing, but not other services, such garage to be in lieu of private garages within a block or portion of a block.

(47) Garage, private means an accessory building for the storage only of motor vehicles.

(48) Garage, public means a building or premises which is operated for commercial purposes and used for the storage, care or repair of motor vehicles.

(49) Gross public floor area means the total area of the building accessible or visible to the public, including showrooms, motion picture theatres, motion picture arcades, service areas, behind-counter areas, storage areas visible from such other areas, restrooms (whether or not labeled public), areas used for cabaret or similar shows (including stage areas), plus aisles, hallways and entryways serving such areas.
